Last Updated: September 11, 2026
These Terms of Service (“Terms”) govern your use of the FSO website, platform, events, membership programs, creative services, digital services, marketing services, event services, sponsorship opportunities, and related offerings provided by BLKNGLD LLC DBA FSO and its affiliates.
By accessing or using FSO services, you agree to these Terms.
If you do not agree, do not use the website or services.
1. About FSO
FSO is a creative, digital, marketing, event, and community platform.
FSO may provide or facilitate:
- Creative services
- Graphic design
- Brand enhancement
- Digital marketing
- Website services
- Social media services
- Event planning
- Event production
- Event curation
- Event promotion
- Event layout and production support
- Sponsorship opportunities
- Membership programs

- Other services introduced by FSO
FSO may modify, add, or discontinue services at any time.
2. Eligibility
You must provide accurate information when using FSO services.
If you are submitting information on behalf of a business, organization, event, or another person, you represent that you have authority to submit that information.
3. Accounts and User Information
You are responsible for maintaining accurate information associated with your account or submissions.
You are responsible for activity conducted through your account.
You must not provide false, misleading, fraudulent, or deceptive information.
4. Services and Project Agreements
Specific services may be governed by an individual proposal, estimate, statement of work, service agreement, invoice, or other written agreement.
If a project-specific agreement conflicts with these Terms, the project-specific agreement may control with respect to that project.
5. Payment Requirements
FSO operates on an upfront-payment model.
Projects Under $500
Projects with a total project price under $500 require 100% payment in advance.
FSO will not begin design, development, production, marketing, or other project work until the required payment has been received.
Projects $500 and Over
Projects totaling $500 or more generally require a 50% deposit before work begins.
The remaining balance will be due according to the applicable proposal, agreement, invoice, or payment schedule.
FSO may establish different payment requirements for specific projects when agreed to in writing.
No 30-Day Invoicing
Unless expressly agreed to in writing, FSO does not provide 30-day invoice terms.
Online Checkout and Merchant of Record
Purchases made through the FSO website checkout are processed by our payment provider, Stripe. Depending on your location, Stripe may act as the seller of record for your order — handling tax compliance, fraud protection, disputes, refunds, and transaction-level customer support — and your payment statement may reference LINK.COM* together with our brand name. For other orders, BLKNGLD LLC remains the seller and your statement references our business.
When you purchase a membership, event ticket, or other product through the FSO website checkout, your payment, billing, applicable taxes, and any cancellation or refund mechanics are also governed by our payment provider's applicable terms, available during checkout.
6. Quotes and Estimates
Quotes and estimates are not automatically contracts.
A project becomes scheduled for production only after:
- The project scope has been accepted;
- Required payment has been received; and
- FSO confirms the project.
FSO may decline a project before accepting payment or entering into a project agreement.
7. Scope Changes
Requests that materially change the original scope of work may result in additional fees.
Examples include:
- Additional design concepts
- Additional revisions
- Additional pages
- Additional marketing campaigns
- Additional event services
- Changes after approval
- Additional meetings or production requirements
- Rush requests
- Additional deliverables
Additional work may require additional payment before production begins.
8. Client Responsibilities
Clients are responsible for providing accurate information, content, approvals, files, logos, images, copy, access credentials, and other materials reasonably required to complete a project.
Delays caused by missing information, late approvals, unavailable materials, or client-requested changes may affect delivery timelines.
9. Creative Approval
Once a client approves a design, concept, proof, or deliverable, FSO may treat the approved version as final.
Changes requested after approval may result in additional charges.
10. Intellectual Property
Unless otherwise agreed in writing, FSO retains ownership of original concepts, drafts, unused concepts, working files, templates, processes, internal systems, and other materials that are not expressly transferred to the client.
Final deliverables are provided according to the terms of the applicable project agreement and payment status.
Third-party fonts, stock photography, software, music, templates, plugins, and other licensed materials remain subject to their respective licenses.
11. Portfolio and Promotional Use
Unless a client expressly requests otherwise in writing before project completion, FSO may display completed work in its portfolio, website, social media, marketing materials, presentations, and promotional content.
FSO will not intentionally disclose confidential information solely for promotional purposes.
12. Event Listings
FSO may allow users, businesses, organizations, venues, promoters, or other parties to submit events.
Submitting an event does not guarantee publication.
FSO may review, edit, approve, reject, modify, suspend, or remove event listings.
Event organizers are solely responsible for the accuracy, legality, safety, ticketing, scheduling, venue arrangements, permits, refunds, and fulfillment of their events unless FSO has separately agreed in writing to provide those services.
13. Event Tickets
Event tickets purchased through FSO or a third-party ticketing provider are subject to the applicable event and refund policies.
FSO does not guarantee that an event will meet an attendee's personal expectations.
Event organizers may establish event-specific rules.
14. Membership
FSO may offer paid membership programs.
Membership benefits are determined by the membership level purchased.
The FSO Social Club membership currently provides members with free entry to FSO events, subject to applicable event capacity, registration requirements, age restrictions, venue restrictions, and event-specific terms.
Membership does not automatically include third-party events that are merely listed or promoted on the FSO platform.
Membership fees and renewal terms will be disclosed before purchase.
15. Sponsorships
FSO may offer sponsorship opportunities.
Submitting a sponsorship form does not constitute acceptance or create a binding sponsorship agreement.
FSO may review and approve sponsorship requests before issuing a contract or payment request.
Sponsorship benefits are determined by the applicable sponsorship agreement.
FSO may decline sponsorships that conflict with its values, policies, event requirements, legal obligations, or business interests.
16. Third-Party Services
FSO may integrate with third-party platforms for payment processing, ticketing, scheduling, email, website hosting, analytics, social media, or other services.
FSO is not responsible for outages, errors, policies, or actions controlled by third-party providers.
17. Disclaimer
FSO provides services and website functionality on an “as available” basis.
We do not guarantee that the website will always be uninterrupted, error-free, secure, or available.
18. Limitation of Liability
To the maximum extent permitted by law, BLKNGLD LLC DBA FSO and its affiliates will not be liable for indirect, incidental, consequential, special, or punitive damages arising from use of the website or services.
Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.
19. Indemnification
You agree to indemnify and hold harmless BLKNGLD LLC DBA FSO and its affiliates from claims, losses, liabilities, damages, costs, and expenses arising from:
- Your violation of these Terms
- Your submitted content
- Your unauthorized use of another person's intellectual property
- Your event or business activities
- Your violation of applicable law
- Your misuse of FSO services
20. Termination
FSO may suspend or terminate access to the website, membership, community features, listings, or services when reasonably necessary, including for violations of these Terms, fraud, abuse, unlawful activity, nonpayment, or conduct that creates risk to FSO or others.
21. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
22. Changes
FSO may update these Terms periodically.
The updated version will be posted with a new “Last Updated” date.
